1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide when you register on the Services, express an interest in us or our products, participate in activities on the Services, or otherwise contact us.

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

We may also process your information for other purposes only with your prior explicit consent.

If you are located in the EU or UK, the GDPR and UK GDPR require us to explain the legal bases we rely on.

Use of AI technologies

We provide AI Products through third-party AI service providers, including Google Cloud AI. Your input, output, and personal information may be shared with and processed by these providers to enable the AI features described in this notice. You must not use AI Products in a way that violates any AI service provider terms or policies.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in using a social media account, we may have access to certain information about you.

We may receive profile information such as your name, email address, friends list, profile picture, and other information you choose to make public, depending on the provider.

We will use the information only for the purposes described in this Privacy Notice or otherwise made clear on the Services. We do not control how your third-party social media provider uses your data, so you should review their privacy notice directly.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. Your information may be transferred to, stored by, and processed by us and by third parties we work with in the United States and other countries.

If you are a resident of the EEA, UK, or Switzerland, those countries may not provide the same level of data protection as your home country. We will still take measures necessary to protect your personal information in accordance with this notice and applicable law.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

No purpose in this notice requires us to keep your information for longer than the period of time in which you have an account with us, unless a longer retention period is required or permitted by law.

When we no longer have an ongoing legitimate business need to process your information, we will delete or anonymize it, or if that is not possible, securely store and isolate it until deletion becomes possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through organizational and technical security measures.

We have implemented appropriate and reasonable measures designed to protect the security of personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure.

We cannot promise that hackers, cybercriminals, or other unauthorized third parties will never defeat those safeguards. Transmission of personal information to and from our Services is therefore at your own risk, and you should only access the Services within a secure environment.

11. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age or the equivalent age required by law in your jurisdiction.

By using the Services, you represent that you are at least 18 or the equivalent age in your jurisdiction, or that you are the parent or guardian of such a minor and consent to that dependent's use of the Services.

If we learn that personal information from a child below the applicable age threshold has been collected, we will deactivate the account and take reasonable measures to delete the data promptly. If you become aware of such data, contact privacy@openuser.ai.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on where you live, you may have rights that give you greater access to and control over your personal information.

In some regions, including the EEA, UK, Switzerland, and Canada, these rights may include access, copy, correction, erasure, restriction, portability, and objection rights, plus human review of certain automated decisions when applicable.

We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and believe we are processing your information unlawfully, you may complain to your Member State data protection authority or the UK data protection authority. If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent

If we rely on consent to process your personal information, you have the right to withdraw that consent at any time by contacting us or updating your preferences. This does not affect the lawfulness of processing before withdrawal.

Marketing opt-outs

You can unsubscribe from marketing emails by using the unsubscribe link in the message, replying "STOP" or "UNSUBSCRIBE" to SMS messages, or contacting us. We may still send non-marketing service messages that are necessary to run your account or respond to requests.

Account information

  • Request account termination and we will deactivate or delete your account and information from active databases, subject to legal and operational retention needs.

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems offer a Do-Not-Track setting you can activate to signal a privacy preference not to have your browsing activities monitored and collected.

Because no uniform technology standard for recognizing and implementing DNT signals has been finalized, we do not currently respond to DNT browser signals or similar automatic mechanisms. If that changes in the future, we will explain the new practice in an updated version of this Privacy Notice.

14. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Residents of certain US states may have rights to access, correct, copy, delete, or restrict how their personal information is processed.

This applies to residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, subject to applicable law.

We retain Categories A, B, C, G, I, and L for as long as the user has an account with us.

How we use and share personal information

Learn more in sections 1, 2, and 4. We may disclose personal information to service providers under written contracts. We may also use personal information for our own business purposes, such as internal research for technological development and demonstration.

We have not disclosed, sold, or shared personal information to third parties for a business or commercial purpose in the preceding twelve months, and we will not sell or share personal information in the future belonging to visitors, users, or other consumers.

You may designate an authorized agent where allowed by law. We may deny requests from agents who do not provide proof of valid authorization.

Request verification

We may verify your identity using information already maintained by us or request additional information when needed to confirm identity, authority, or to prevent fraud.

Appeals

If we decline to take action regarding your request, you may appeal by emailing privacy@openuser.ai. If an appeal is denied, you may submit a complaint to your state attorney general where applicable.

California Shine the Light

California residents may request information about categories of personal information disclosed to third parties for direct marketing purposes and the names and addresses of those third parties once per year, free of charge, by contacting us in writing using the details in section 17.

Australia and New Zealand

We collect and process personal information under the obligations and conditions set by Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020.

This Privacy Notice is intended to satisfy the notice requirements defined in those laws, including what information we collect, from which sources, for which purposes, and with which recipients it may be shared.
